Privacy and privacy breaches in anonymous online environments

My thesis deals with the offence of unlawful invasion of privacy in the Penal Code 4:6 c, an offence that protects the privacy of individuals by criminalizing the unlawful dissemination of information about others that violates their privacy. An example of an act criminalized by the introduction of the offence is the dissemination of images showing how someone has been subjected to a crime against the person. In my work, I explore the boundaries of the criminalized area - I clarify which types of acts are covered, which fall outside and identify both unclear borderline cases and certain problems in the construction of the crime. In the thesis, the limits and problems I have identified are put in relation to the internet environment in which criminalization is said to be intended to operate. An important factor in such an environment is the possibilities for encryption and anonymous communication, and I therefore examine these possibilities and relate them to the technical and criminal procedural possibilities of the judiciary to prosecute crimes. My study highlights particular difficulties that arise in this environment and outlines how a different approach to criminalization could both compensate for some of these difficulties and provide individuals with greater criminal justice protection.
