We increasingly use photographs when we communicate. Digital photos are very easy to produce, most people have access to a digital camera on their mobile phone or laptop. Digitization of communication channels has increased the possibilities for individuals, interest groups and traditional media to easily publish photos and to easily share other people's photos. In parallel with the increased use of photos, there is a growing interest in being able to critically review them and to use someone else's photo without their permission. The scope for critical examination of photos without the author's permission - an interest in freedom of expression - is limited in the Copyright Act, and digital images in particular are excluded in important respects. This situation is unsatisfactory from a freedom of expression perspective. The aim of this project is to critically examine whether an appropriate balance is maintained between copyright and freedom of expression in relation to photographs and, if necessary, to propose appropriate solutions. The issue will also be considered from an EU and Convention perspective.
